The unfairness must be so severe that it is shocking to the average person. It usually includes the absence of any meaningful choice on the part of the buyer and contract terms so one-sided that they unreasonably favor the seller. A contract will be terminated if the buyer can prove unconscionability.
Credit cards, mortgage companies and quick loans often try to bind you with contracts that are unconscionable. If you read that entire definition, you'll see that the seller (loan company) can no longer have an unfair advantage over you. Mortgage rates that are not fixed are no longer allowed to get out of hand. Credit cards put in place to help you establish credit can no longer have unrealistic terms. Quick loans are no longer allowed to take advantage of your adverse situation.
If you can prove it, you are out of it.
One case I know for sure where I heard this term used by the judge was Judge Mathis. A pawn shop owner who worked with celebrities, the type of celebrities who would be in the limelight one day and then down and out the next, had accepted items from one particular individual. When the individual returned to pick up his items, they were damaged. The pawn shop owner had words in his contract that released him of liability if the items were damaged.
Mathis called this unconscionable. If you are a pawn shop owner and you take charge of items for a period of time for an amount of money, you are responsible for returning those items in the condition they were received. Otherwise, your contract is written so one-sided that it unreasonably favors you. It becomes unconscionable.
Remember that when you are dealing with people. Not just credit cards and loan companies. Every contract you are bound by has to be fair for both sides.
This fact is one of the factors making it easier for you to demand competition of creditors. They have to compete now because they've been forced to "conscionable..."

Before you start saying you can't sell, consider the ways on the internet that you don't have to sell. Allow me to give you some ideas of how to make money online promoting merchant products...without "Selling."
Yes, that's right! You don't have to know how to sell to make money online. Even if your bottom line is to sell products for other merchants, there are ways to get out of selling.
First of all, let's define selling. Selling is calling people and trying to pitch them your product. Selling is going door to door or person to person to try to sell people on a product. Selling is emailing people with the intent of pitching a product. You don't have to do any of that stuff.
So, let's walk you through a process that might make you some money if you do it right.
Two years ago, I wrote a short, 7 or 8 page DIY manual about in ground swimming pools. I had observed enough that I was capable of putting together an in ground swimming pool with a liner and a filter system. Of course, there was more to it than that. But, it was basically rather simple.
Before I published the DIY at Associated Content, I visited several online swimming supplies merchants and found a good one to market. They had an affiliate program, which means I earn money for every item I "sell" for them. That means liners, filters and other items.
Once my affiliate status was approved and I received my affiliate identification, I published the DIY with all of my links in it. I wrote several articles and published them on Ezinearticles.com as well as Associatedcontent.com. I published a few reports in Scribd and I created a Squidoo lens. I also published my own web page with all the items listed with pictures, descriptions and pricing. The whole nine yards.
People read the manual and click on my links. They read the articles, the reports or visit my lens and click on the links. When they buy the items I mention, I get paid.
I made $10,000 that summer. That was two years ago and I'm still making money from work I did back then. Every Spring, my manual jumps in readers. Then, the buying begins all over again.
I've completed several things just like that and I enjoy a nice little living...without "Selling." Yes, technically I'm selling several items for a merchant. But, I don't make phone calls. I don't go door to door. I don't talk to anyone about the items.
I simply write a DIY and mention the items that will be needed. I get affiliated with a merchant who sells those items and I direct people to that site. I use as many resources as I can to get the information out there and I sit back. The system is put into place and now it's time to reap the benefits of my labor.
That's just one way. If you don't know how to write, you should learn. But, you don't have to be a writer to make money online. There are other ways of doing it without "Selling." But, selling either your own products or someone else's is the best way. The million dollar potential is always there!

It seems that people just can't get enough of games. It's like they keep pumping them out before anyone gets a chance to play the last one.
Do you know that the game Ironman is already out? I haven't even seen the movie yet. Quite honestly, I didn't even know it was out.
Games are big time. That Grand Theft Auto series is blowing up, forgive the pun. It's controversial and plenty of parents are trying to keep their kids away. But, what can they do? It wasn't like we listened all the time.
They're selling like wildfire. Chances are that the kid or adult down the street is going to have one.
But, what started it all? Now, that's a good question. Because I'm not talking about Space Invaders or Pong. I'm talking about what started this level of game?
Was it SIMS? I mean, they do come across as so realistic. In fact, people have made videos with them. I remember watching a SIM video to the song Angel by Sarah Mclachlin. It was pretty good. The boy loses his parents in a house fire, lives in an orphanage for a few years and then gets loving foster parents at the very end. Touching.
But, there are other things just as realistic. Like the war games people play online. A guy from Texas and a guy from Florida are on the same team with a guy from New York and another from Washington.
One time I watched them make a video of one of their wars. It appears that one guy fell asleep and they couldn't wake him up. So, they kept doing funny things to him. They dropped him off a cliff. They shot thousands of rounds at him. There was just no waking him up. It was hilarious.
Anyway, I think the fantasy is to live a life you never could and make it as real as possible. I thought games were an escape from real life. Something to take your mind off of life.
But, real life games can teach people things. Just as much good as bad, but you learn things either way. It's just that games have come so far who knows how much further they can go?
When people get credit cards, they go off on them. Now, I've heard so many people say they will only use their card in an emergency. But then, the taste of credit gets in their mouths and they go off on the card.
Starting off with good intentions is what they always do. Months later, they are deep in debt and wondering how they are ever going to get out of debt. That's the shame about credit.
Now, I think people should be responsible with their credit. But, I know that the credit cards have the entire game stacked on their side. That's why legislation is being pushed to make the rules more fair.
Excessive rates are no longer allowed.
Contracts that have excessive terms are no longer allowed.
Incentives even exist to help people get out of debt and to wipe the slate clean.
I once received a credit card in the mail and I threw it away because the rate was 24% and there was a huge activation fee as well as a huge annual fee that would have been applied to my balance right off the bat. I would have been left with credit of about $100 and I didn't need the card in the first place.
I wasn't sure why they were sending me a card. I didn't need any credit boost. I don't have the best credit, but I can get what I need. I threw the card away.
A month later, I received a statement from the credit card company. I flipped. I wrote them back and asked them to verify that I have a credit card with them. In fact, at the time I had forgotten about throwing the card away.
They never answered and then it took me months to get their card off of my credit report. That was round and round. You have to protect your credit.
Get only legitimate credit cards. And if you're going to use them, make sure you have the money to pay the balance.
A friend of mine uses his credit card for everything. He pays his bills online and he does his monthly shopping with it. But, he saves his money and collects the interest. Then, when the statement comes he sends the payment in full on the due date. That gives him a few extra weeks with the money in his savings account.
If anyone were going to have a credit card, I would suggest that you do it that way. But, good credit cards do exist and I think everyone should have one just in case.
